01. Agreement to Terms

By accessing cxfoto.com, submitting a booking request, or purchasing services from CX FOTO, you agree to these Terms of Service, subject to applicable law.

If a separate written service agreement applies to your project, that agreement will control in the event of a conflict with these general website terms.

If you do not agree with these terms, please do not book services through our website.

02. Our Services

CX FOTO provides professional photography and visual marketing services for residential and commercial properties.

Available services may include:

• Interior and exterior real estate photography.
• Aerial photography and video using drones.
• 360-degree property photography and virtual tours.
• Property marketing images and digital media.
• Additional services described on our website or in a written quote.

Service availability, deliverables, equipment, and pricing may vary by property, location, and selected package.

03. Appointments & Bookings

Customers may request or schedule photography services through our website or authorized communication channels.

A booking is confirmed only when CX FOTO issues a confirmation or otherwise accepts the appointment.

Customers must provide accurate information, including the property address, contact details, selected services, and any relevant access instructions.

CX FOTO may contact customers to clarify project details, adjust scheduling, or resolve issues affecting service delivery.

04. Pricing & Payments

Prices are based on the selected services, property characteristics, and any applicable additional fees disclosed before purchase or agreed to by the customer.

Additional charges may apply to requests outside the original scope, including extra photography, extended travel, additional editing, or repeat visits.

Payment requirements, including any deposit, advance payment, or remaining balance, will be communicated during checkout or in the applicable quote.

CX FOTO may withhold delivery of final media until amounts properly due have been paid, subject to applicable law and the agreed payment terms.

05. Cancellations & Rescheduling

Customers who need to cancel or reschedule an appointment should contact CX FOTO as soon as possible.

Any cancellation fees, rescheduling charges, refund eligibility, or non-refundable deposits will be governed by the cancellation policy disclosed at booking or otherwise agreed to before payment.

Weather conditions, property accessibility, safety concerns, or other circumstances may require CX FOTO to reschedule a session.

When a session cannot proceed, CX FOTO will communicate available options consistent with the applicable booking agreement and consumer protection laws.

06. Property Preparation

The customer is responsible for ensuring the property is ready for photography at the scheduled appointment time.

Recommended preparation includes:

• Cleaning and organizing interior spaces.
• Removing clutter and personal items.
• Opening blinds and preparing lighting.
• Securing pets and arranging access.
• Preparing outdoor areas and landscaping.
• Removing confidential or sensitive materials from view.

Unless specifically agreed, CX FOTO does not provide cleaning, staging, furniture moving, or property maintenance.

Delays or additional work caused by an unprepared property may require a revised schedule or additional charges, if disclosed and agreed.

07. Property Access & Safety

Customers must ensure CX FOTO has lawful permission to enter and photograph the property.

The customer must disclose known safety hazards, restricted areas, access limitations, or conditions that could affect the session.

CX FOTO reserves the right to pause, modify, or decline work where conditions present an unreasonable safety risk.

Drone operations are subject to applicable FAA regulations, airspace restrictions, weather conditions, and operational safety requirements. Drone coverage cannot be guaranteed for every property.

08. Photography & Creative Standards

CX FOTO uses professional judgment regarding composition, lighting, camera angles, editing, and image selection.

Final results may vary due to weather, natural light, property conditions, available shooting time, and technical or regulatory limitations.

Unless specifically agreed in writing, the customer does not receive every photograph captured, unedited RAW files, or source project files.

The number and type of final deliverables will follow the purchased package or written project agreement.

09. Media Delivery & Revisions

Completed images and other media may be delivered through a digital download link, online gallery, cloud service, or another agreed method.

Estimated turnaround times are not guaranteed unless expressly agreed in writing. Delays may occur due to technical issues, project complexity, or circumstances outside reasonable control.

Customers should review delivered media promptly and report any concerns within the review period, if one is specified in the applicable agreement.

Additional revisions or editing beyond the original service scope may be subject to separate fees.

10. Copyright & Image Licensing

Unless otherwise agreed in writing, CX FOTO or the applicable rights holder retains copyright in photographs and media created through its services.

Subject to full payment, the customer receives a non-exclusive license to use delivered media for marketing and promoting the property or project for which the media was commissioned.

The customer may use the delivered media in property listings, marketing materials, social media, and related promotional channels within the agreed scope.

Resale, transfer of independent usage rights, or unrelated commercial reuse by third parties requires separate authorization unless expressly permitted in the applicable agreement.

This license does not transfer ownership of copyright or rights to unedited source files.

11. Portfolio & Promotional Use

CX FOTO may request permission to display completed photography projects in its portfolio, website, social media, and promotional materials.

Any such use is subject to the applicable agreement, permissions, privacy requirements, and other legal restrictions.

Customers should identify any confidentiality, privacy, or publication restrictions before the photography session.

12. Customer Responsibilities

By booking CX FOTO, the customer agrees to:

• Provide accurate booking and contact information.
• Ensure authorized access to the property.
• Prepare the property for the scheduled session.
• Disclose relevant safety or access concerns.
• Communicate material scheduling changes promptly.
• Pay applicable fees according to agreed terms.
• Use delivered media within the permitted license.
• Respect applicable intellectual property and privacy laws.

13. Third-Party Platforms

Our website may use third-party providers for payments, booking, hosting, communication, mapping, and media delivery.

Certain services may also be governed by the applicable provider’s terms and privacy policy.

CX FOTO is not responsible for independent third-party platforms beyond the extent required by applicable law.

14. Warranties & Limitation of Liability

CX FOTO will use reasonable care and professional judgment in providing its services.

To the extent permitted by applicable law, CX FOTO does not guarantee that photography services will produce a particular property sale, rental, marketing result, or financial outcome.

Nothing in these Terms excludes liability that cannot legally be excluded or limits rights and remedies that cannot legally be waived.

Any additional liability limitations applicable to a specific project must be established through an enforceable agreement and applicable law.

15. Events Beyond Our Control

CX FOTO is not responsible for delays caused by events outside its reasonable control, to the extent permitted by applicable law.

Such events may include severe weather, natural disasters, power outages, equipment failures, government restrictions, unsafe conditions, or significant transportation disruptions.

Where possible, we will communicate with the customer and work toward an appropriate rescheduling or alternative arrangement.

16. Privacy & Personal Information

Personal information collected through our website, bookings, and customer communications is handled according to our Privacy Policy.

17. Governing Law

These Terms of Service are governed by the applicable laws of the State of Florida, United States, without limiting any mandatory consumer protections that may apply.

CX FOTO may update these Terms of Service periodically to reflect changes in our operations, service offerings, or legal requirements.
